E-2 Visa Application Questionnaire

This questionnaire gathers the information your attorney needs to advise you and to prepare your E-2 treaty investor petition (Form I-129 with the E-1/E-2 Classification Supplement) and its supporting package. It usually takes 30 to 45 minutes to complete in full, though you can save your progress and return to it at any time before submitting.
It will save time if you have the following to hand:- Your passport (photo/biographic page), plus any current or prior US visas.
- If you are already in the United States: your most recent I-94 admission record and evidence of your current status (for example, a prior I-797 approval notice).
- Details of the US business you are investing in or acquiring — its legal name, formation documents, ownership, and address.
- The investment documents — the purchase agreement, any escrow agreement, and confirmation of funds transferred.
- Evidence of the source of your investment funds — for example business-sale proceeds, savings, or other lawful sources — with bank records showing a clear trail into the investment.
- Proof of any amounts already spent or committed to the business — lease, build-out, equipment, and inventory, with receipts.
- The business's financials and staffing — recent accounts or tax returns, a payroll or employee list, and your hiring plans.
- A short summary of your background and experience (a CV/résumé) showing how you will develop and direct the business.
- Details of any dependents (spouse and children under 21) who will apply with you.
- Any prior US immigration applications or petitions filed by you or on your behalf.
Answer as fully and accurately as you can. Where a question doesn't apply to you, say so rather than leaving it blank. If you're unsure of an exact date or figure, give your best estimate and flag it — your attorney will confirm it with you. Everything you enter is used to prepare your petition, so completeness and accuracy matter, particularly for the amount and source of your investment.
